DEFINITIONS

LEWD, LASCIVIOUS, INDECENT ASSAULT OR ACT UPON OR IN THE PRESENCE OF A CHILD. FLORIDA STATE STATUTE 800.04
A person that commits an act on a victim under the age of 16 in a lewd manner can be convicted of the above charge. The words lewd, lascivious and indecent mean the same thing and are defined as a wicked, lustful, unchaste, licentious or sensual act on the part of the person doing the act. A person can also be convicted of the above charge if they commit a lewd act in the presence of a victim under the age of 16. In the presence of the victim means that the victim saw, heard, or otherwise sensed that the act was taking place. There are many possible actions that could fall under this statute. A few examples are as follows: a person that masturbates in the presence of the victim, a person that lewdly exhibits their genitals, a person that fondles or handles the victim in an indecent manner. To know what specific conduct a particular offender committed to be convicted of a lewd or lascivious act you would need to contact the clerk of court or law enforcement agency in the jurisdiction where the crime was committed.
